Q) We have an issue with a driver who states there is no requirement to carry his digital tachograph card when driving our HGVs as he only drives under GB Domestic rules. Is this correct?

A) If a driver has been issued with a digital tachograph card, they will need to carry it with them and be able to produce it whilst driving professionally, regardless as to whether they are driving under GB domestic drivers’ hours rules or EU rules in an analogue vehicle.

The below extract is taken from Section 4.1 of DVSA’s GV262 guidance:

Drivers who have been issued with a driver card are committing an offence if they are unable to produce this during a roadside inspection, even if they only drive analogue tachograph-equipped vehicles.

Q) We have been asked to transport a small quantity of UN0454 Igniters in a small box weighing 1.5 grams for a school. The packaging is UN Approved. What do we require to be able to move it?

A)  UN0454 is a class 1.4S, which is an explosive, but it falls under Transport category 4 in the Small Loads exemption in table 1.1.3.6 of ADR. This means that you can carry an unlimited amount of UN0454. Requirements for the driver and vehicle are:

The driver would require driver awareness training and the vehicle would require a 2kg dry powder fire extinguisher. There are no requirements for ADR markings to be displayed on the vehicle for the quantity carried. A dangerous goods note would also be required.
